This notice describes categories of Personal Information and Sensitive Personal Information that organicgirl, LLC ( “organicgirl”) collects and the purposes for which it processes that information in accordance with the California Consumer Privacy Act of 2018 ("CCPA") and the California Privacy Rights Act of 2023 ("CPRA").

organicgirl is committed to protecting the privacy and security of personal information of current and former employees (collectively “Employees”) and contractors and their emergency contacts and beneficiaries.  organicgirl does not sell or otherwise disclose Personal Information and Sensitive Personal Information for monetary or other consideration to any third parties.

Exercising Your Rights

If you are a California resident, applicant, or employee, you may exercise any of your rights under the CCPA or CPRA. organicgirl will not discriminate against you for exercising your rights under the CCPA or CPRA, including but not limited to:

I. Personal information We Collect

Personal Information 

Applicant
What we Collect - Identifiers such as name, contact information (i.e., email and phone number), address, signature; education history; and employment history.
How it is Used - Evaluation process for candidates for employment.

Post Offer
What we Collect – Sensitive Personal Information such as: driver records; social security numbers; and/or other government issued ID numbers confirming eligibility to work in the United States; characteristics of protected classifications under California or federal law, such as age, marital status, gender, sex, race, color, disability, citizenship, primary language, immigration status, military/veteran status, disability; request for leave; medical conditions; age; date of birth.
How it is Used – Validating eligibility to work, obtaining/verifying background and consumer record checks.

New Hire
What we Collect - Bank account and other financial information; and biometric information such as imagery of the fingerprint or other physical patterns.
How it is Used Tracking time and attendance and processing payroll.

Active Employee
What we Collect – Worker compensation and leave of absence requests that require medical information regarding employees’ respective medical situation; email, computer, internet, network, telephone, and mobile device usage information, such as browsing and search history, IP address, log-in information, time and location related to use of internet websites, applications, or device, and interactions with online systems and websites and any personal information that you provide while accessing organicgirl’s  computer systems; audio and visual information.
How it is Used – To provide a service or support to the employee; performance management; tracking of time and attendance; processing payroll.

Benefit Eligible Employees
What we Collect – When required for benefit enrollment and administration name, gender, contact information, address, and dependent information such as name, date of birth, and contact information.
How it is Used – To administer and maintain benefits including group health insurance, retirement, and other related benefit programs.

Third Parties
What we Collect – If you request entry upon organicgirl property, you may be subject to security video recording, review of government-issued identification, and limited storage of government-issued identification.
How it is Used – Any collected materials are used exclusively to ensure the safety and security of organicgirl property and employees. To the extent there is a security incident, such materials will be reviewed and may be shared with law enforcement officials or other appropriate authorities.

II. How Personal Information is Collected We collect most Personal Information and Sensitive Personal Information directly from you; however, we may also collect the information from the following:
  • Publicly accessible sources (e.g., court records, social media sites, social networking sites);
  • Directly from a third party for background checks, credit reporting agencies, or drug and alcohol testing;
  • A third party, such as a bank, financial institution, or advisor (with your consent);
  • Consultants and other professionals we may engage in relation to your matter;
  • Our Information Technology systems, including:
    • Online case management, document management, and time recording systems;
    • Door entry systems and reception logs;
    • Cookies on organicgirl websites;
    • organicgirl’s IT systems;
    • Building security systems; and
    • Security cameras.
III. Other Purposes for Which Personal Information is Collected
The purposes for which organicgirl will collect or use your Personal Information include:
 
  • To comply with state and federal law and regulations;
  • To maintain commercial insurance policies and coverages, including worker’s compensation and other liability insurances;
  • To aggregate data to perform workforce analytics, data analytics, and benchmarking;
  • To conduct and accomplish our business operations, objectives, and administration in connection with matters as your employer or potential employer, such as:
        • Emergency services;
        • Maintaining our facilities and infrastructure;
        • Quality and safety assurance measures;
        • Conducting risk and security controls and monitoring;
        • Protecting confidential and trade secret information;
        • Performing identity verification;
        • Performing accounting, audit, and other internal functions, such as internal investigations;
        • Complying with the law, legal process, and internal policies;
        • Maintaining records;
        • Claims processing;
        • Responding to legal requests for information and subpoenas,
        • Exercising and defending legal claims;
 
  • To comply with our internal business processes and policies;
  • To prevent unauthorized access and modifications to our systems;
  • Exercise or defend the legal rights of organicgirl and its employees, affiliates, customers, contractors, and/or agents; and
  • Any other purposes authorized by the CCPA, CPRA, or California or Federal law.

IV. Disclosure of Personal Information
organicgirl shall use a reasonable standard of care to store and protect from disclosure any Personal Information or Sensitive Personal Information collected using the principles of least least-privileged access and by limiting access to Personal Information and Sensitive Personal Information to only those individuals with a 'need to know'. organicgirl utilizes appropriate physical, technical, and organizational security measures and procedures to store and to protect Personal Information and Sensitive Personal Information from unauthorized use, loss, alteration, destruction, or modification.

organicgirl shall retain your Personal Information  and Sensitive Personal Information until the initial purpose for collecting and retaining such data has been satisfied. If you subsequently agree to a new or additional purpose, your Personal Information or Sensitive Personal Information may be retained further for that reason. Lastly, organicgirl may be obligated to share Personal Information or Sensitive Personal Information in the event organicgirl is subject to a request for disclosure associated with any applicable legal or regulatory obligation.

We only share your information with the following third-party entities:
 
  • Service providers organicgirl uses to help deliver benefits and services related to your prospective or actual employment, such as identity verification providers, payment service providers, time and attendance programs, benefits programs, and more;
  • Third parties approved by you (e.g., your legal counsel, assessment and background check providers, and others);
  • Law enforcement, government entities, and pursuant to the legal process where required by law;
  • Prior employers you provide to us (e.g., for reference and to verify employment history);
  • Professional references you provide to us;
  • Educational institutions you provide to us; and
  • Affiliates for purposes of your placement and job performance.

We grant our service providers and affiliates access to Personal Information only to the extent needed for them to perform their functions, and we require them to protect the confidentiality and security of such information.
 
V. Selling of Personal Information

organicgirl DOES NOT sell your personal information.  organicgirl will not sell the Personal Information collected and will not share information with third parties for the purpose of cross-context behavioral marketing. 
 
VI. Length of Time Personal Information and Sensitive Personal Information will be Retained

organicgirl generally retains the information it receives about you for a period of 10 years, unless a shorter or longer period is required by applicable California or federal law.

We reserve the right to modify, revise, or otherwise amend this Notice at any time and in any manner.  Any new version of this Notice will be posted on organicgirl’s intranet.  This Notice will be reviewed annually and updated, as necessary.
